Disclaimer and Limitation of Liability as to Products Sold
All of SouthSmoke.com's products are guaranteed against defects for 48 hours from the date that the recipient receives the merchandise. By ordering from SouthSmoke.com, you agree and certify under penalty of perjury and as per State and Federal guidelines that you are at least 21 years of age or older, and able to purchase Hookahs, Flavored Tobacco, and other Hookah merchandise in your state. By ordering from SouthSmoke.com, you also agree that SouthSmoke.com has up to 14 business days to ship your merchandise out of our facilities. Once an order has been shipped and/or tracking information has been received from FedEx, UPS, Airborne Express, or the USPS, a customer cannot cancel and/or refuse delivery on their order without prior consent from SouthSmoke.com via email or US Mail. SouthSmoke.com reserves the right to charge a fifteen percent restocking fee on any order returned to our company after final inspections. SouthSmoke.com also reserves the right to charge any applicable fees that may have been associated with the order at the time of shipping if merchandise is returned to our facilities. Any merchandise returned to our facities must be unused and in all original packaging. Any merchandise deemed used will be refused by SouthSmoke.com and will be returned to the customer at the customer's expense. If a Return Merchandise Authorization (RMA) was issued by SouthSmoke.com, the customer is responsible for paying the return fees associated with the FedEx/UPS standard rates guide if the merchandise is deemed used, not in its original condition, or is returned because the customer was not satisfied with the merchandise and SouthSmoke.com has concluded that there is nothing wrong with the merchandise received back in our facilities. SouthSmoke.com has Except as expressly stated herein, SouthSmoke.com makes no representations or warranties, either express or implied, of any kind with respect to products sold on the SouthSmoke.com sites. Except as expressly stated herein, SouthSmoke.com expressly disclaims all warranties, express or implied, of any kind with respect to products sold on this site, including but not limited to, merchantability and fitness for a particular purpose. You agree that the sole and exclusive maximum liability to SouthSmoke.com arising from any product sold on the SouthSmoke.com sites shall be the price of the product ordered. In no event shall SouthSmoke.com its directors, officers, employees or other representatives be liable for special, indirect, consequential, or punitive damages related to product sold.
In the event of a chargeback or non-payment against SouthSmoke.com through our consumer or business channels, the account holder will be responsible for all fees regarding collections. These fees include, but are not limited to, the North Carolina Service charge, $25 chargeback fee issued by the credit/debit card issuer, all applicable collection agency fees incurred by SouthSmoke.com, all attorneys fees and legal costs incurred, original shipping charges incurred by SouthSmoke.com, and return shipping charges incurred by SouthSmoke.com. In the event of non-payment, the customer will be responsible for the costs of the merchandise at the time of order.
All Hookahs and smoking accessories sold at SouthSmoke.com are intended for legal Tobacco smoking use by adults (21 years or older) only. Any other use of such products, by minors or for use with controlled substances is prohibited by and may constitute a violation of International, Federal, State, and/or Local Laws.
By entering the site, you: (1) agree to SouthSmoke.com Terms of Service; (2) verify you are at least 21 years of age; (3) verify that Tobacco products, Hookahs, and smoking accessories are sold legally in your County, State, and Country; (4) agree to use the products offered herein for legal and intended uses only; (5) verify you are not visiting with any malice towards SouthSmoke.com (6) by entering this site you are observing any and all local laws and (7) irrevocably waive any and all liability resulting from the purchase and/or use of such products. Typographical Errors
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, SouthSmoke.com shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. SouthSmoke.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, SouthSmoke.com shall immediately issue a credit to your credit card account in the amount of the charge.

Sales and Other Applicable Taxes
SouthSmoke.com shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within Florida and North Carolina. Each customer shall be solely responsible for all sales taxes, tobacco taxes, or other taxes, on orders shipped to any other state other than the State of North Carolina.
Service and Support
All requests for technical service and support should be made directly to the manufacturer in accordance with their terms and conditions. SouthSmoke.com will provide on-line technical notes on most computer hardware & software products.
Jurisdiction and Venue
You agree that any legal action brought against SouthSmoke.com shall be governed by the laws of the State of North Carolina, county of Mecklenburg without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the SouthSmoke.com sites or through mail order, telephone, fax, or email shall be an appropriate federal or state court located in Mecklenburg County, North Carolina.
